In a recent ruling, U.S. Delaware District Court Judge Maryellen Noreika rejected Hunter Biden’s motions to dismiss three federal gun charges against him, undermining claims of “selective and vindictive prosecution.” The decision comes amidst heightened scrutiny over perceived double standards in light of President Joe Biden’s executive orders on gun control.
Biden’s legal team argued that he was unfairly targeted, citing Department of Justice statements indicating a focus on prosecuting firearm offenses involving violence or threats to public safety. However, Judge Noreika emphasized that Biden failed to provide “clear evidence” of selective prosecution or discriminatory intent in his case.
The judge highlighted the stringent criteria required to prove selective prosecution, noting that even if Biden had demonstrated a “discriminatory effect,” he would still need to show that the decision to prosecute him was based on an unjustifiable standard. This would entail proving that the prosecution was motivated by factors such as race, religion, or political affiliation, which Biden’s legal team did not substantiate.
Furthermore, Judge Noreika ruled that a pretrial agreement dropping the charges against Biden was no longer valid, clearing the path for the trial scheduled to commence on June 3 in federal court in Wilmington, Delaware.
The charges against Biden stem from allegations of falsifying information on a federal form to purchase firearms and illegal possession of a firearm while using narcotics. Federal prosecutors indicted him on three counts of illegal possession of a firearm, accusing him of lying about his substance use during the acquisition of a handgun from a gun store in 2018.
In addition to the gun charges, Biden is also facing felony charges for tax evasion in other federal courts, adding to the legal challenges he currently confronts.
The ruling underscores the impartiality of the judicial process, as Judge Noreika upheld the charges against Biden based on the evidence presented, irrespective of his familial or political connections.
