Dear Mr. Hicks,
I am writing to you for clarification regarding the requirements of our commissioners under Oregon state law and the Josephine County Charter.
I am concerned that Vice Chair Chris Barnett is not acting appropriately or in compliance with the law when he declares himself to be the Chair. I understand that one of the duties of the Vice Chair is to fill in for the Chair as a temporary Chair when the Chair is temporarily absent. It is also my understanding that when the Chair is permanently gone, the Board must elect a new Chair in a public meeting. That has not happened.
My questions are these. How soon after the Chair position is vacated must a new Chair be chosen in a public meeting?
What happens if the two remaining commissioners disagree on who should be Chair?
Are any of the actions taken by a commissioner self-identifying as Chair valid when he is, in fact, still the Vice Chair?
